Please Define: "At War With the US"

Provisions of the National Defense Authorization Act (NDAA) bill, currently being considered in the US Senate, would authorize the military (sections 1031 and 1032 of Senate Bill 1867, the “National Defense Authorization Act for Fiscal Year 2012” to unilaterally haul away and imprison anyone anywhere in the world without charge or trial—including US citizens in their homes.

President Obama's lawyers say American citizens are legitimate targets if at war with the US, and that only the "executive branch, not the courts, is equipped to make military battlefield targeting decisions about who qualifies as an enemy". However, not to worry, President Obama has promised to veto this bill.

Today, Anwar al-Awlaki, a U.S. citizen and "leading al-Qaida figure". Tomorrow, whoever pisses off our government.
